Special counsel prosecutors accused Manafort in November of breaking a plea deal by lying to the special counsel's office.

It remained unclear if the polling information Manafort allegedly shared was public or private, though it raises speculation that the data could have been used by the Russians to interfere in the election in an effort to support Trump's candidacy.

"Issues and communications related to Ukrainian political events simply were not at the forefront of Mr. Manafort's mind during the period at issue and it is not surprising at all that Mr. Manafort was unable to recall specific details prior to having his recollection refreshed", they write.

The filing contains new information about Manafort's connections to Konstantin Kilimnik, a Russian-Ukrainian business associate who was indicted previous year on charges he tampered with potential witnesses. (See Doc. 460 at 6).

Manafort sent Kilimnik, a former Russian military intelligence official, an email in April 2016, shortly after joining the campaign, suggesting that he sought to use his new position as leverage with Deripaska. Kilimnik has also already been charged by Mueller with witness tampering.

"These occurrences happened during a period when Mr. Manafort was managing a US presidential campaign", they wrote.

"This does not constitute outreach by Mr. Manafort to the President", a redacted line in the filing claims, while another redacted sentence says another identified interaction is "hearsay purportedly offered by an undisclosed third party". It's a major acknowledgment from the Mueller team that their investigation into Russian interference in the 2016 election is finding potential contact between at least one Trump campaign official and the Kremlin.

If he is found to have intentionally lied to the Federal Bureau of Investigation, the government could seek a tougher sentence - including a maximum of life in prison. He's also suffering from depression and anxiety, it said.

Court watchers and the judge anticipated that the Manafort team would either push back on Mueller's team's assertions-like they previously indicated they would-or agree not to fight the special counsel as Manafort headed to sentencing.
